Pursuant to Iowa Code Chapter 69, the Board of Supervisors shall fill the County Attorney position by appointment. The Board has by Resolution changed the status from Full-Time to a Part-Time position with the benefits of an Elected Official that also allows for the individual to retain their private practice that will not conflict with the County Attorney position.
The period of the appointment shall be until the next pending election. The current County Attorney was duly elected to this position on the November 8, 2022, ballot and has declined the position. Electors of Mills County have the right to file a petition requiring that the vacancy be filled by special election. Electors have the right within fourteen (14) days after publication of this notice or within fourteen (14) days after the appointment is made to file a petition with the County Board of Supervisors requiring the vacancy be filled by special election.
